No appearance of defendant. Judgment for plaintiff for amount w ith co&ts £2 lli». Thk Hyland-Lumsdkn Ei'i*oi>k. N. H. Lum->den, a hor&e-tr.iiner, was charged on the information of J. F. Edgar \yifch assaulting and beating him on the fith iii^t. The accused pleaded guilty. Mr K. W. Dyer appealed for the infoimaut, and briefly stated the circumstances of the case. The accused had met the informant at the Criterion Hotel and asked to have a few words with him privately, which was granted. He (Lumsden) asked Mr Edgar had he written certain letters which were recently published over the signature of DArcy Hyland, and without any further "habitation struck hint. Lumsden had subsequently expressed his intention if fined to renew his conduct. Thid statement was borne out by the evidence. Complaintant ask«d that accused be bound over to keep the peace. Accused said he did not mind paying a fine, but asked the court not to bind him over to keep the peace. He had been a considerable time in the district, and had i never been brought before the court for misbehaving himself on any former occasion. He had been a little excited on the occasion, or else he would not have conducted himself as ho had. Did not remember having made use of threatening language. Mr Edgar, he thought, had been very rough on him since he came to the district. His Worship administered a severe caution to the accused. He would not bind him over to keep the peace, but ho would tell him this, That if he were again brought before the court for a similar offence he would be sent to gaol without the option of a fine. He would fine him 20.s and costs, £2 7s.
