[lit TELEGUArH.— OWN CORUESPONDEN'T.! Ti: Auoha, Wednesday. Tiik protest lodged by Mr Cooper's supporters against the validity of the la.st election of councillor for this riding was heard to-day before Mr Kcnrick, R.M., and resulted unfavourably for Mr Murphy, wlio was declared not duly elected. The court ruled no vacancy occurred on September 9th, as stated by the county clerk in giving notice of election. The vacancy m reality dated back to Mr Whitaker's resignation, consequently Mr Murphy's election was not within the presciibed time. Tho Court held that Mr Cooper was btill in possession, and had as good a claim to a seat in the council as the other members declared elected by the same returning officer, though none were legally elected. There were no means of unseating them now, therefore Mr Cooper must be regaided as the member. Some informality also evicted respecting the notification of election. The advertisement was dated September 20th and tho written appointinont of the new returning officer is dated three days later ; consequently the notification was irregular. Mr Miller appeared for Mr Murphy. For tho other s-ide appeared Mr Mills, one of the protestors.
