W. N. fteaiancke, justice of the peace and ceitified inteipretci, deposed that in December, 18S3, he attested to tlie transfei of a block of l.md containing 1000 acu 1 -., known as the Waotu block, No. 2, ci»n > cv « d by Aiekatera and otheis to K. B. Wai! 01 and other 1 ., that m ISB3 thf Native L.m Is Couit attested a j)oition of the block sul<l, and that no fresh signatures to the deed weie made, but the transferors wont <>\n their signatures on the old deed w ith a di y pen. The question was, whether going over hignatmes by the signatmies with a dry pen was the main question to be decided ? Mr Alexander put in the deeds of s,,l(> by Aiekateia and others to the cveditiis' tiustee of 1000 aciOb. Mi Jloslcßth lawod an objection to tui deed being put m as evidence, on the qiound that the fiaud c<:inniia«ionei'& ceitilicite was not on the deed. His Honour over-ruled the objection. Mr Hcskcth contended that as the deed had not boon legisteied it had no legal force. His Honour contended that the deed ought to have been legistered, but that the onns.sion did not render it invalid. It might be received upon evidence. The case is not concluded.
