Constable OJillies lepresented the police, and the following evidence was adduced. — ■ James Joseph, a half-caste belonging to the Kuiti deposed : about live o'clock yesterday I was with the deceased. His horse shied, but deceased kept on, and the hoi se rushed into a wire fence on the side of the load, and Mr Fleming fell head o\ei heels. When ho fell he called to me to vet him away from the hoise. I tiied to lift him but failed. Ernest Kusab*, deposed : —About half past hve yu»teiday evening last witness culled me and I went to the spot where the accident happened, and found deceased unconscious, on his back, w ith blood on his foiehead and noso. He was- about five yaid.- f loin the horse, winch wan entangled in the wiie fence. I went to deceased's lesidence for assistance and when I returned deceased said he was paialysed and had lecehed concussion. Maiia Zellmann, deposed: — Joseph asked me to bring some water for Mr Fleming, who was half dead. L did so and Joseph bathed his face. He (deceased) said "That will do." He seemed unconscious William Alexander Cushny, M.D., deposed: — L am a .siugoon, residing at Cainbridge. I received an urgent telegram last night, leque&ting me to attend deceased, who had been thrown from his horse. I received the telegram ai, half-past seven, and arrived about nine. On arrival, I was infoi tiied that Mr Fleming had died. I evamined the body and believe death had taken place two hours before. I again examined the body to-day. There is a niaik on the foie.he.id as if it had been forcibly struck. On the head, in tho region of tho right eye, is a contusion. There is considerable lividity at the back of the neck, getting fainter towards the right shoulder. Deceased, whom I knew, was a very heavy man. I attribute death to a very seveie injuiytothe upper portion of the spine. Such injury would be caused by the deceased being thrown from a horse. This was all the evidence, and the jury, without retiring, returned a verdict of "Accidental Death."
