RESIDENT MAGISTRATES' COURT, CAMBRIDGE.
Yesterday.— [Before Mr H. W. Northcroft, R.M.] CIVIL CASES. Official Assignee t. Matilda Morgan, claim £10 6s 2d. No appearance of defendant. This was a claim made by the plaintiff on account of the estate of Robert McVeagh. Mr Dyer for plaintiff. A sum of £4 had been paid into court. Judgment for plaintiff for full amount with costs (£2 13s). I. Bates v. H. Burt.— Claim, £7 Is lOd, for goods sold and delivered. No appearance of defendant. Judgment for [plaintiff for amount, with costs, £1 2s. Official Assignee v. John OBrien. — Claim, £5 5a Gd. Mr Dyer for plaintiff and Mr Keesing for defendant. Mr Keesing showed that the amount had been paid, andjproducedthe receipt for the full amount. He would therefore ask for full costs and expenses for defendant, who had come the whole way from Te Aroha. — Mr Dyer said it was evident a mistake had been made on the part of the assignee. The defendant, however, should have notified him on his intimating to proceed against him for the sum named.— Mr Keesing contended that his client being seven miles from a telegraph station had no opportunity of sending word, and the notice was vry short. — His Worship considered defendant entitled to costs under the circumstance?.—Judgment for defendant, with £3 3s costs.
