The P ETITION AGAINST THE PUKEKURA LICENSING ELECTION.

Ar the Ite'sident Magishate's Court, Cambridge, yesterday, before Mr H. \V. Noithcroft, R M., the case of the petition against the lecent licensing election of Pukokm'.i dibti ict was bi ought forward. The clerk read the following petition:-—" We, the undersigned electois of the Pukekura L censing Distuct, hereby declare that we veuly believe that at the election to the office of members of the Pukekuia Licencing Committee, holden nt the schoolhouse, Cambridge We.-t, and at the council chambers, Ohaupo, on the fouith day of Maich, 1884, at which (lane, Fisher, Reynolds and Morns were declared to be duly elected to the said office, the election of the said Gave, Fisher, Reynolds and Moms is void, u])on the following grounds :—That poisons \oted at the said election who were not entitled to vote thereat. And we pray that enquiiy may be made into the .said election under the provisions of the " Regulations of Local Elections Act, 1870," and that the said election may be said to be \oid. Uiven undei our hand* this 17th day of March, 1884: Michael Moirissey, Charles Dunn, Charles O'Neill, Josiah Hill, William Hickey, and Catheii'ie Wylie, elect n«. —Declai ed at Cambiidge West, aforesaid, by the six persons signing this petition, on the 18th Maich, 1884, before me, A. Clements, J.P." Mr Hay appeared for the petitioner, and Mr ~F. A. Whitaker appeared with Mr Campbell for the candidates whose election was 1 disputed. Mr Hay a>ked for the sealed packet of voting-papeis and roll —The Court informed Mr Hay that these papers were not in the possession of the Cambridge Court. — Mr Campbell stated that the law laid down that these papers should be forwarded by the returning officer to the clerk of the court at the neatest R.M. Court. The Hamilton Court, he understood, was the neatest to Ohaupo. —His Worship presumed that it was the couifc neaieat to the chief polling-place that the Act meant. —MiHay thought it was the court nearest to the licensing district to which these papei.s should be fonvaided. —Mr Hay said if it was the R.M. Court neaiest to the principal polling place, that would be Te Awamutu, and the papers he presumed being theie he would have to ask for an adjournment.—Mr Campbell would oppose the adjournment unless costs were paid. Witnesses had been brought from considerable distances and at much expen.se, and in I such cases the couit could direct such expenses to be paid. Mr Hay before coming into court should have assured himself as to whether the papers were there or not, and as he had not done so, and consequently required an adjournment, he did not see why he should not be mulcted in costs. —Mr Hay thought it was a great injustice to the petitioners that they should be mulcted in costs, as they were acting in this meeting in the capacity of public benefactors.—The case was then adjourned till Tuesday, the Ist April, and if the defendants defeat the petitioners the latter to pay costs, and if the reverse the costs to be allowed for the day of adjournment.
