From the evidence adduced, it appears that Kelly bought the cow in question from one Charles Hall for £2 ss, tho arrangement being that if the purchase money was not paid by the Bth mst. the animal was to be returned. On the 7th defendant offered the cow to Mr Bach, and eventually ,she was bought by the latter for £0. Plaintiff fetched her in from defendant's paddock, and on arrival at the hotel Kelly assisted to put the a>w in the bail, when she was milked. Nothing was said about payment that day, but on the Bth Kelly asked for a squaring up. Bach told him of a contra account, and Kelly said that if he did not get the money he would take the cow back again. Plaintiff warned him not to do anything of the kind, or he would " make it hot for him." Defendant, in his evidence, said he had distinctly told plaintiff at the time the latter brought the cow to the hotel that it was not a sale till the money was paid. Counsel having addressed the court, his Worship made an ordei for the payment by defendant of £6 or the return of the cow.
