KUMARA, Saturday.

An important decision was given in the -&.M. Court to-day. George Simmonds was summoned by George Stewart, who claimed £30 penalty for Simmonds acting as Borough Councillor when incapable under the 4th subsection of the Gist section of the Municipal Corporations Act, 1876. Dr. Gillies, R.M., gave judgment for the plaintiff, and said : "It . cannot be disputed that the work in the present case was done for the Council and paid for by the Council, and I am afraid nothing has been shown which could relieve the defendant fiom the penalty. I regret that I have no power to mitigate the penalty, but it appears to me that the tiJiiintifF is entitled to judgment for the amount claimed, with jcosts." In another similar case brought Simmonds under the same clause '< \jV I)nncan McClennan, another penalty ,j^£so and costs was inflicted.
