Important Land Case. In the Supreme Court to-day, in the case Robert Cooper v. Win. Colemnn, F. Clarke, W. L. Rees and Wi Pere, a motion to dismiss action, Mr Thos. Cooler appeared for plaintiff, and Mr A. B. Whitaker for defendants. Plaintiff is a sheep farmer at Poverty Bay. This action was brought last year with the object of securing a re-conveyance of certain mortgaged lands.. which Coleman and Claike (as trustees in Read's estate) had sold for £25,000 to Rees and WiPere, the sums advanced on them amounting to £25,460. PLiintift in his declaration affirmed that a few days previous to the sale they agreed to a three years' extension of his mortgage and then suddenly disposed of them, and he declared that the land was fraudu; Jently sacii tied to Rees and Wi Pere, its leal value being £100,000. The declaration was filed in July last year, and since then no step has been taken in the matter. Upon this ground, Mr Whitaker moved for a dismissal of the action. Mr Cooper replied, and his Honour then ordered that unless the next step should be taken within two months the action shall be dismissed.
