LICENSING COMMITTEE ELECTIONS. Nominations.
The nominations for the first election under the new act for the districts of Rangiaohia, Mangapiko and Hamilton, took place yesterday, and so far as the two first named ai'e concerned appear to have created considerable interest. For Rangiaohia the following have been nominated to fill the five seats at the committee ; — Messrs. C. J. Storey, W. S. Rutherford, T. Parker, W. Johns, J. H. Mandeno, E. Parsons, W. Hutchinson, J. Elmsley, "W. Taylor, Andrew Kay, and J. Walton. For Mangapiko the following nominations were received : — Messrs Lang, Grierson, J. I). Hill, Hodgson, Westney, and J. Aubin. For the Hamilton district only one nomination was received, and as this candidate is ineligible under the disqualification clauses, the Governor will in this case, by virtue of powers vested in him under clause 13, section 7 of the act, appoint a committee. The elections for the district of Mangapiko and Rangiaohia take place on the 27th inst. Nominations for the districts of Cambridge, Pukekura, Waitoa, Te Aroha, Rangiriri, Kirikiriroa, Newcastle, and the Borough of Hamilton, must be forwarded to the respective polling places before noon of the 18th instant (Saturday).
For the information of intending candidates, we print clauses 11 and 12 of the Act, relating to disqualification: — 11. No person shall be qualified to be elected or to act as a member of a licensing committee — Who is a brewer, wine or spirit dealer, malster, distiller, importer for sale of or a dealer in liquors, or in partnership with any such person, or who acts as the agent or auctioneer for any such person; who is interested in any such business, or in any such house or building or premises as mortgagee or otherwise j who is the owner in fee or for any less estate of any licensed house, or house or building or premises in which any trade in or manufacture of liquors is carried on ; who has within four years been bankrupt or insolvent, and has paid a less dividend than 10s in the £ upon his debts. No person shall be qualified to be elected or to act as a member of a licensing committee during the time he holds a paid office under the Government of the colony, or under the council of any county or borough. 12. Any person so disqualified acting or sitting as a member of a licensing committee shall be liable to a penalty of fifty pounds for every such offence : Provided that — (1.) No person shall be disqualified by reason of his having vested in him a legal interest only and nota beneficial interest in any premises herein mentioned or the profits thereof; (2.) t No person shall be liable to a penalty for more than one offence committed 'by him before the institution of any proceedings for the recovery of such penalty ; (3.) No act done by any disqualified person shall by reason only of such disqualification be invalid ; (4.) No objection shall be . made to, any licenses granted, re-, newed, or removed in pursuance of this , Act on the ground merely that the licensing committee who granted,, rev newed, or removed the s'anie were not qualfied to matfe such' grant, renewal, or removal. , , -, _..,;>« ,
