ACCIDENT TO THE PENGUIN (PER TELEGRAPH).

Ouu Wellington correspondent wires : — An inquiry into the Penguin case commenced to-day, before Mr Hardcastle R.M., and Captains Whitwell and Scotland, as assessors. Mr Shaw appeared fcr Captain Malcolm,Mr Bell for the Union Co., and Mr Edwards for Popen, Chief Officer. The evidence of Mr and Mrs Watson passengers was taken which showed that Captain Malcolm was perfectly sober and on deck. [Te was asleep on the skylight until shortly before reaching the pass. He was apparently very tired, as Collins another passenger deposed that the Captain was perfectly sober and attentive. When the beacon was picked up he heard the Captain give orders to starboard, which was obeyed. He thought if the order to port had been given the vessel would have got through all right. The night was dark and squally. An adjournment till Wednesday was asked for and granted. The Court called on Captain Malcolm to deposit his certificate as there was prinia facie evidence that the vessel went ashore in consequence of his order to starboard. All the witnesses spoke highly of the conduct of the captain and chief officer.
