[Ykstkrday. — Befoie H. W. Norfchcroft, Esq., KM., and His Worship the Mayor.] Civil Cases. Hay v. Hug hes, —Claim, Ll4 6s, amount of dishonored promissory note, with interest. Mr Speed for plaintiff, and Mr O'Neill for the defendant. The case had been adjourned in order to settle a point raised by the Magistrate as to whether the transaction re the bill should not have been translated to defendant, who is a half-caste. Counsel and Bench now agreed th.it such a proceeding was only made by statute to refer to land transactions, and judgment was given for plaintiff for amount claimed and costs. Small and Goatcs v. Henderson. — Claim, L 4 10a 9d, amount of judgment summons. Mr Speed for plaintiffs. Defendant said he was getting 6s per day on the railway when he worked, but for a long time he had not only had to support his family of three children, but to keep his wife in the hospital. He could not make any promise just yet, but would [do his best. Case adjourned fora month, in order to give defendant an opportunity to make some arrangement. Cummmg v. Bell. — Claim, L 7 14s 2d, t for money lent and goods delivered. Mr Speed for defendant, who deposed that the money was given to his mother | by plaintiff's wife before she was married. | He had never heard about it, although the transaction was made five years ago, until about three months ago. Had never got goods for plaintiff, as per bill. Plain- | tiff admitted that he was not present ' when the money was paid, but had j been told it was lent. The Court gave judgment for defendant with costs.
