WARDEN'S COURT. December 21st and 22nd.— (Before H. Kenrick, Esq).

J. W. Guilding v. Cole and others. — Application for surplus ground — The applicant applied to have this case adjourned till January 6, which was granted on payment of witnesses costs. Thomas Kneebone r. J. Gibbons and others. — Mr H. E. Whitaker for complainant. — Applicant applied for forfeiture of the Morning Light claim on the grouuds that it was not being worked. There was no appearance of the defendants, and the Warden declared the ground forfeited, and placed applicant in possession. Frater y. Jones, Brown, Fitzpatrick and another. This case arose "out of the dispute as to the ownership of lot 7, block 1. After hearing the evidence the Court adjourned for a few minutes to enable ths party to settle among themselves, when all the claimants, with the exception ol Mr Jones, agreed to draw lots, Mr Fitzpatrick being successful, the case was then brought into Court to decide between Jones and Fitzpatrick. The Warden divided the allotment between them. J. Moses v. Leydon, claim to lot 4, blook 1 ; divided between the claimants. La very and others v. Messenger and others. — Mr O'Neill for complainants. — This was an actiou brought by Lavery and party of the Waitoa Claim, against Messenger aud party, for trespass. After voluminous evidence had been taken, defendants were ordered to remove their pegs.
