Hesketh, on behalf of defendant. — Mr O'Neill, for plaintiff, opposed it, on the grounds that in all probability the matter would be settled amicably; *and, if not, that defendant mijrht be ousted under the Highway Bo.irda Empowering: Act, 1871, sec. 27, which would be inexpensive. On tho other hand, the appeal would be very costly. — Permission granted, on Bocurity for cost (£3O) being deposited in Court, and execution was stayed.
