HAMILTON BOROUGH COUNCIL.

Tub usual fortnightly meeting" of the Council was lielrl at the Council Chambers on Tuesday evening. Present: — His Worship the Mayor, Councillors Jones, Mullions, McGarrigle, White Davis, Vialou, Peat, and Pearce. . The minutes of previous meetings were read and confirmed, and the outward correspondence was read and approved. A letter was read from Mr J. Boylan, C.E., Auckland, offering to do the whole of the Borough engineering for a period of six months for the sum of £42. " After some discussion ifc was resolved on the motion of Cr McGarrigle— " That the Clerk write to Mr Boylan asking him whether these terms would be available at any time during the ensuing six months." An application from Mr A. T. Potter for a license to slaughter small cattle on lot No. 22, Hamilton East, was granted. A telegram was read from the Minister for Pubhc Works, dated 6th inst., stating that an engineer had been instructed to report on the bridge. A telegram from the Under- Secretary for Public Works, dated 7th inst, stated that the District Engineer had been instructed to examine and report on the bridge, and that the report was daily expected. The Mayor said Mr D. M. Beere, C.E. (Resident Engineer), had been examining the bridge, and they had better defer further action in the matter until they got the report from the Government. This was agreed to. A letter was read from Mr J. 0. Gavin, enclosing copy of correspondence relative to the terms upon which the loan had been raised. alleged misapplication of the bridge fund. Ther had never before been in possession of the terms of the arrangement, and it was very satisfactory to find from them that the Council could provide for tho maintenance and repairs of the bridge out of the'tolls. The letter was received. Mr Daley, the bridge toll collector, wrote stating that Mr James Coombes had driven one two-borae dray and two onehorse drays over the bridge, for which he refused to pay the toll, olaiming exemption under the bridge regulations, in that he resided within a mile of the bridge and was taking his horse to feed and water. Cr. Peat wished to know whether Mr Goombes was taking his drays to water. Or. Jones thought the collector should make a further demand for the amount of the toll to Mr Coombes. The Mayor thought they should proceed against him for a breach of the bye-laws. Cr. Vialou said the collector had power by law to seize some of the property of the offender, and to call the police to his aid. Cr. McGarrigle thought it very probable that Mr Coombes might have made the mistake in error, and he should again be asked to pay. Cr. Jones moved, "That the toll-keeper be instructed to ask for the money, and to point out to Mr Coombes that the word ' dray ' is not mentioned in the list of exemptions." This was seconded by Cr. Pearce and oarried. A petition signed by Mr J. Petherill and others, praying for certain repairs to be effected in Rostrevor-street, was read. It was resolved that, after the furze had been cleared off Selkirk -street, the foreman of works be instructed to give one day's work to remove furze in Ros-trevor-street. An application from Mr H. McPherson, for permission to work out the amount of his rent owing upon a portion of the domain lauds, was referred to the Domoin Board. The Works Committee reported on the several matters referred to them. It was resolved that as the Councils' account at the Bank was overdrawn up to the limit allowed, they could not undertake any works in Clyde-street at present. The application of Mr Cussen to have some pipes laid down under the footpath near his property, was refused. The matter complained of by Mr J. K. McDonald, regarding the water on his proi perty, was deferred, pending the receipt of the repot t from the Government Engineer on the bridge. It was ordered that that the foreman of works should make some necessary repairs in Wellingtonstreet. It was resolved to accept the A ender of Mr Kingsley, for the formation of Vic-toria-street, at £15 6s, the work to be done "before any payment is made, and the work to be completed in one mouth. Cr Me Garrisrle moved in accordance with notice — " That in order to carry out the desire of the Burges.»es, re Seddon's claim, it was expedient that an amendment proposed by the Mayor and seconded by Cr Vialou, entered in the minute book (No. 15), dated 18th May, be reveked." This was seconded by Cr Davis. The Mayor move I as an amendment — " That the said resolution be not rescinded, but that it is desirable that the matter of the relations of this Council with Mr Seddon ba placed iv the hands of jVEr Whitaker, senior, for his opinion." On being- put to the Council there voted for the amendment ; The Mayor Crs Peat, Pearce, Mullions, and Vialou; for tho motion : Crs Davis, White, McGarrigle, and Jones. Cr Jones moved, in accordance with notice— "That resolution No. 11 (13th July) be rescinded, and in lieu thereof that Mr Vialou be required to pay the sum of rfjd per yard for the earth put into his yard, and that Mr Calderwood be employed to measure the same." Cr Mullions seconded. Cr Peat moved as amendment — " That it is desirable that the resolution of 13th July be not rescinded, and that Cr Vialou was out of order according to 7oth claufe of Municipal Corporation Act, 1576." For the amen lment there voted:— Crs Peat, Davis, White and McGnrrigle ; for the motion : The Mayor, Crs Vialou, Pearce, Jones, and Mullions. The motion was therefore carried. The Town Clerk read the statement of funds as follows: — General account,overdraft, £687 16s lid; special fund account, £2 17s Id. He explained that £133 10s, due and promised, by the Government, would be added to tho latter amount. The Council then rose.
