AMENDED LICENSING ACT, 1874. SHORT ANALYSIS FOR GENERAL INFORMATION

Licensing Courts as constituted under Licensing Act, 1873, to be deemed duly constituted. Licenses granted declared valid. Prorincial Acts or Ordinaries passed by Provincial Legislature to remain in force, except where inconsistent with Licensing Act, 1873-74, sections 4, 13, 14, 15, 16, 17, IS o the Act, 1873 repealed, and other provisions made for con. stitution of Liconsing Courts and Ordinary of said Court. Three membe rs of Licensing Courts to form a quorum. Holders of licenses may have more than one bar on -payment of additional fee. Wholesale and Packet Licenses to be obtained from Provincial Treasurer without certificate from Government. Persons holding Brewing Licenses not required to take out wholesale license. Provisions of Distillation Act not affected by Licensing Act. Existing Licenses to stand good until 30th June, unless perfected under any law in force. Quarterly licensing meetings to be held on first Tuesdajf in months of December, March, June, and September for purpose of taking into consideration such application for Certificates, Renewals, Removements, and Transfers of Licenses, of which duo notice in writing of at least twentyono day* has been given to the Clerk of the Licensing Court. Clerk of Liecnbing Court to give at least one month's notice of quarterly meetings in one newspaper circulating in the district. Certain forms as laid down by Licensing Act, 1873, and Amendment Act, 1874, to be adopted on application for License, Removal, or Transfer of License. Said notice to be handed to the Clerk of Licensing Court together with i fee as provided by the act, at least twenty-one days previous to quarterly meeting. Applications for new licenses to be accompanied by certi- j ficate from at least ten householders. Certificate* from householders unnecessary on application for Renew nl of License. Application for Bottle License to be applied for in same manner as Publican's License, and may be granted in sucli provinces only as may have provided, and shall hereafter provide for the grant and issue of such license. Personal attendance unnecessary to procure renewal of license unless notice of opposition stating grounds thereof be given to the Clerk of Licensing Court, who shall forward copy of notice of objection to person interested. Notice of all meetings of Licensing Court to be given in duplicate to Clerk of Liconsing Court. Objections to Transfer of Licenie may be m»de by giving notice to Clerk. Purchasers of Licensed Premises may obtain temporary transfer of license on application to Chairman of Licensing Court, and payment of certain fees to the Provincial Treasurer. Licenses may be transferred to other promises on application to Court and on payment of feo t© Provincial Treasurer. The Residont Magistrate, or any two members of Incensing Court may grant extension of license to Races, Fairs, Market, Rowing Matches, Cricket Grounds, or other like places of public ammrmrnt on certain special condition?, or may on occasion of Public Dinner, Ball, or other festivity permit any house or premises to be kept open for such period as ho or they may think fit. Chief othcer of police in every distiict or some oflicer of police shall, ten days before each quarterly meeting, give report in writing of every licensed house in Ins district. Applicants for new licenses to deposit with Clerk of Court plans of house for which license is applied for. Chairman of Court to have casting vote in addition to oi filial vote. Decision of Court once announced not to be questioned or reconsidered. Notice of objection to grant of certificate to bo given to persous affected thereby. Persons insulting Chairman or Members of Court to be liablo to penalty or in default imprisonment. Oifleis by Licensing Court shall and may be enforced in the same manner as an order of judgment of a Resident Magistrate.
