RESIDENT MAGISTRATE'S COURT, HAMILTON Tuesday, 16th June. (Before W. N. Searancke, Esq., R M., and R. T. Seddon, Esq., J.P.)
Hpnt v. Ellison. TIII3 was an action brought to recover the snm of 14s for work and labour done by the plaintiff for the defendant. It. appeared that in the month of April, 1873, an arrangement ffsi entered into by several farmers of East Hamilton to hire a thre»hing machine, and to giye to each other mfficient labour to complete the threahing of their respective crops. The plaintiff, it seems, wai under the impression that the arrangement was to extend to the year 1874, and accordingly in April last, called on the defendant to assist him in his threshing. This defendant declined to do. It so happened that defendant's crop in 1873 was a larger one than plaintiffs, and occupied a longer time in threshing. Plaintiff, therefore, on the refusal of defendant to assist sued him for the balance of work and labour done in April, 1873. Mr Madden appeared for plaintiff ; Mr Whitaker for defendant. Considerable discussion took place upon points of law between the Counsel engaged, and a non.suit was finally recorded nith costs £4 49 Od.
Kb Criterion Hotel, Te Awamutu. Mr Whitaker, who appeared for Mr Costello, the present owner of the above hotel, applied for a transfer of the license from Canny, the late proprietor, to Costello. The Bench granted the application, obirrrinp; that they were glad to find that the hotel had fallen into good bandi.
HARPER Y. DtTNCAN. George Duncan was given in charge by James Harper, the landlord of tho Hamilton Hold, for creating a disturbance in the said hotel on the evening of the 15th instant. On tho morning of the 16th, be wtis charged bj Harper, on information, with neglecting his duty as a servant. This charge was dismissed on the ground that the Master and Sonants' Act of Englnnd did not apply to a servant hired at \wiges for domestic purposes Mr Madden appeared for tho defendant.
Same v. Samk. Defendant was charged with using insulting and abusive language calculated to provoke a breach of the peace, contrary to the provisions ol the Justices' of the Peace Act, 1866 Mr Madden for defendant. Prom t lie evidence it appeared that defendant hod, in consequence of some dispute) told the informant that he was 'no gentleman ' mid usod furtliei harsh language. The Bench appearing to consider that the words, although uncomplimentary, wero not insulting to informant dismissed the case.
The R o gistrar-Grenornl has given instructions to Mr Buz zard, Superintendent Registrar of St James's, Westminster io allow the registrar* ot births in that parish to give every person who registers the birth of a child a copy of Doctor Lunkaster'e ' Plain rules for tho management of infants.' These rules have been drawn up by Dr Lankastcr under the conviction that a largo amount of death amongst children is due fo tho want of knowledge on the pnrt of the mother as to how to manage them whilst they are infants. Th action on the part of the vestry of St James's, Westminster in printing these 'rules' for distribution in their p»nsh is undoubtedly a »tcp in tbo right direction, and thero can be no doubt, if all other parishes in tho kingdom would do thiT same, a large amount of valuable information would bo disseminated, and the lives of thousands of children would be ■ared.
