DISTRICT COURT, WESTPORT.
(Before his Honor Judge Harvey.) ; Monday, Dec. 22. In Bankruptcy. Be Alexander Neill. Mr Sbapter appeared as counsel for bankrupt. A full statement of accounts for six months previous to date of insolvency had not been filed in proper time, and hearing of case was adjourned until 24th February next. Be W. L. Wartmann.—Mr Sbapter for bankrupt, Mr Fisher for opposing creditors. . Bankrupt on examination admitted tbat be had been sued by the Bank of New Zealand for refund of money paid him in excess for sale of gold, and that the bank had obtained judgment, which being unsatisfied he had been committed to gaol, and thereupon he had filed bis schedule. He had not divided the money overpaid him with his mates and had transferred his share in the claim to Thomas Wardrope on mortgage to receive payment of £lO. Had worked the share up to about three weeks ago, and got gold which wa3 not yet sold, and had now with his mates abandoned tbe claim and took up another, which was at present worked from the same tunnel as that used for working tho former claim. Certificate suspended for three years. Be Henry Williams.—Mr Shapter for bankrupt, Mr Fisher for creditors. Plaintiff was examined as to his earnings as a miner, and tbe circumstances under which his liabilities has been incurred. Certificate granted. In Liquidation. Be Excelsior Company.
