RESIDENT MAGISTRATE COURT.
(Before Joseph Giles, Esq., R.M.) Tuesbay, Dkcembeb 9. In addition to cases already reported the following were also heard : Frank and M'b'arlane v. Beeke.— Claim for £1 12s, value of bar of steel. No appearance of defendant. Judgment for plaintiff in amount claimed, and costs 9s. Carmody v. Harris.—Claim for £l9 19s 9d. Mr Shapter for plaintiff, Mr Fisher for defendant. The short facts of the case were these. Plaintiff and 'one James Noonan had become indebted to John Corr in the sum of £27 19s 6d. It was agreed between plaintiff and Noonan, and defendant, that defendant should purchase share of Noonan in the claim, jointly held by him and Carmody, and that defendant should pay all debts owing on the claim by Noonan up to the time of purchase. Defendant went into occupation, and subsequently Corr obtained judgment against plaintiff for £27 19s Od, and costs, for moneys owing by Carmody and Noonan. Distress was issued and satisfied by plaintiff to the amount of '£39 19s 6d, half of which he now sought to recover. Defendant repudiated all liability for debts incurred previous to his possession of a share in claim. Judgment for defendant with costs. M'Kenna v. Gothard. Disputed account as to pigs. Adjourned until Tuebday next.
WESTPORT WARDEN'S COURT
(Before J. Giles, Esq., Warden.) Tuesday, Decejibeb 9, John Harris, in his own behalf and with others, v. Michael Carmody.—Complaint that defendant had obtained from Patrick Garvin, one of complainants, possession of gold-mining lease, and refused to return the same, whereby Harris was now debarred from selling or transferring his share. Complainants thus sought order enforcing return of lease, and claimed £5 damages. Nonsuit recorded. APPLICATIONS. The applications of Charles Flannery and party for 2a 5r Bp, tunnelling claim north-west of Christmas Terrace, for a term of 5 years, and of William Dams and party, for 10 acres, tunnelling claim, Giles Terrace, for term of 10 years, were both recommended. M'Latchy and seven others for ex. tended claim, double ground for eight men at Giles Terrace. . Granted. John Mees and two others, for headwater rac% Bochfort Terrace. Granted.
