WESTPORT WARDEN'S COURT.

Tuesday, January 14. (Before J. Giles, Esq., Warden.) Landy and Sleigh v. M. Sullivan, and Daniel Williamson—Complaint that defendants had unlawfully interferred with head water race of com plainants and diverted water therefrom, whereby complainants claimed £lO damages and that defendant should be ordered to cease from further interference. Judgment for defendant, damages 20s. and costs 335. Bernard Smyth for self and Murray and others v. J. K. Philpotts—Complaint as to illegal interference with fluming forming part of a head water race near Beaton's Creek, for which it was alleged, plaintiff had improperly obtained protection. The case had been before heard and a nonsuit recorded, as plaintiff had failed to appear at the time the Court sat to give judgment. After re-hearing the case an order was made that plaintiff be allowed to take away the fluming in a month unless defendant pay the value thereof, to be estimated by some indifferent person. Timothy Galium v. Alexander Grant. Complaint that defendant had failed to comply with previous order of the Court to refrain from backing tailings on special site of complainant at Deadmans Creek. Summons dismissed. Defendant disclaiming ownership of dam in question.
