CHARLESTON.
WARDEN'S COURT. Thursday, March, 2. (Before Charles Broad, Esq., R.M.) Ellison v. "Walker (Manager of the Progressive Water Race). Complaint of trespass upon registered site. This was an adjourned case to allow plaintiff to produce certificate of registration. Complainant swore that defendants, by cutting a race through his drainage area, damaged him to the amount of £SO. Thomas Lorton, one of the plaintiffs, corroborated the former evidence. William Molony, a former shareholder in the plaintiff's right, proved that damage had been done to plaintiff by defendant's race. Defendant called John Bird who stated that the ground through which the race had been cut was perfectly watertight. James Henderson also stated that the ground through which the race was cut was solid and, therefore, capable of carrying water. Adjourned to the ground. Clarke v. Mulholland. Mr Gillespie appeared as agent for defendant. Plaintiff sued for £65, alleged to be the value of plant belonging to him, and removed by defendant. James Clarke made a long statement but the Warden considered that he had no case, as he had failed to fulfil the conditions upon which he became possessor of the plant which had previously been held jointly by the plaintiff, defendant, and others. A groat number of applications were heard and disposed of.
