RESIDENT MAGISTRATE COURT.
(Beforeß.C.Eeid, & S. Thorpe, J.P.'s.) Friday, January 13. civil cases. Smyrk v. Lane.—No appearance of plaintiff. Struck out. Melville v. Lane.—Claim for £75. In this case the defendant applied lor an adjournment until Monday next. The plaintiff objected to an adjournment, as he believed the defendant was going to leave the district by the steamer Charles Edward the same day. The Bench btated that they had no jurisdiction to try the case without the consent of both parties to the suit, as the sum involved exceeded £2O. The case would, therefore, be adjourned until Tuesday next. Bull and Bond v. Parer.—Claim for £lO. Judgment for the plaintiffs by do.ault in the amount claimed and costs.
Cooper v. Elizabeth Spinks.—Claim for Bs. Judgment for the plaintiff by default in the amount claimed and costs.
Lane v. Melville.—This was an action for detenuc, iu which the property detained was valued at £l7 18s. The defendant applied for an adjournment until the previous case, Melville v. Lane, had been disposed of. The plaintiff desired the case to be proceeded with. The Bench decided to postpone the hearing, and the case was adjourned to Tuesday accordingly-
, Melville tten applied to the Court for power to detain Lane, who he believed wits leaving the district. He proposed to call evidence to that effect. The Bench, in the lace of there being an action for the detention of property brought by him, in which the same was valued at nearly £2O, refused the application.
