WARDEN'S COURT.
(Before J. Giles, Esq., Warden.) JAAIASOX T. EODDOX. This was a suit arising out of a case tried some time since in which Jamason was defendant and Eoddon complainant. The claim was for £93 being the prico fixed upon an alleged sale of a share in a dam and plaintiff's claim at Ballarat Creek. Mr Pitt appeared for the complainant, and Mr Tyler for the defendant. Tho evidence of James Lowther and the complainant having been taken, Mr Tyler took three or four points for nonsuit. After argument, the Warden overruled the objections, and after hearing counsel and defendant and his witnesses, and reply by Mr Pitt, the Court adjourned. Upon resuming at 2 o'clock, the Warden said it was very difficult to decide the case with anything like satisfaction. The conflict of the evidence was so obvious that either on one side or the ether there was perjury. On which side it lay ho could not venture to decide After reviewing the evidence, his Worship said that the statemade by complainant as to the fact of his selling out, and the amount received by him, led him to believe that the amount paid into Court was sufficient to cover the complainant's claim, and judgment would be entered accordingly, with costs of Court.
