RESIDENT MAGISTRATE COURT.
Friday, N/ov. 27. (Before J. Giles, Esq., E. M.) E. Suisted, owner of the schooner Constant, sued ¥m. Johnson, master of the schooner Charlotte, for an injury sustained by the Constant on the 17th inst. through a collision with the Charlotte. Damages claimed five pounds. The plaintiff's case was, that the Constant was at anchor near Stanley Wharf, when the Charlotte was sailing over from the Lagoon and came in contact with the Constant near the wharf and took away her cross trees and topmast, and that there was no-
thing to prevent the Charlotte from avoiding the Constant and keeping clear of her.
The defendant urged that sufficient time did not elapse from the time the Constant dropped her anchor to the time the collision took place to permit of the Charlotte altering her course.
Several witnesses were examined on each side.
The Magistrate considered that the weight of evidence was with the plaintiff, and that the Charlotte could have avoided collision with the Constant. Judgment for £4 10s and costs, with immediate execution.
