A CURIOUS CASE.
DUTY CLAIMED ON A PKOMIBORY NOTE.
Melbourne, December 16, r Mr Justice A'Beckett has given ' judgment against the Crown in the case in which it claimed probate duty on a promissory note for £536, which Was amongst the effects mentioned in the will of the late Howard Smith. It was a promisoiy note which Was made payable on demand and represented the value of certain shares transferred by the tcstatator to his sons. The Crown claimed that the note was liable to duty, and the defence was that the noto was not intended to be cashed, and was only to enable the father to prevent tlio sons selling the shares. The Judge held that as the stamp had not been cancelled, the document was of no value to the holder, and therefore of no value to the Crown,
