ALLEGED FRAUD.

At the Masterton S.M. Court this morning, Alexander Mitchell came up for judgment in the case in which lie was charged with attempting to defraud John Tucker, publican, by issuing to him a valueless cheque on November 17th, The S.M. asked if Sergt. McArdle (probation officer) had made enquiries. Sergt, McArdle said he had made enquiries, and although the report from Martinborough wa6 not quite satisfactory, several persons resident in this district, who had known the accused for a considerable time, had stated that the man's conduct was always very good except when he was foolish through drink, ■ His Worship said, under these circumstances, as the Sergeant look it upon himself to make the recommendation, a fine would bo intlicted. For the ofieiico, accused was liable to a penalty of £2O, or three months' imprisonment, A line of £5 or in default one months imprisonment would be imposed. At Mr Pownall's request, until next Thursday was allowed to pay tbo fine.

Mr Pownall said nccused intended to pay the £1 to Mr Tucker. His Worship said that had nothing to do with him. He would decline to make anv order for restitution.
