In the case Black v. Brings, the Jury retired at a quarter past six, and returned in about an hour, with the following finding, "We find that words sot out in the statement of claim, wovo used by Mr Jirigga to Mr Smith, in substance and effect, but were made without malico, and we find no damages." The Judge refused to accept the verdict, as, if they found the words were used and that thoy were not true, they must find for the plaintiff. IF they found for a farthing, that would stigmatise plaintiffs action. The Jury, after a further retirement of fen minutes, returned with a verdict fur the plaintiff lor a farthing damages, holding that there had been no fraudulent misappropriation.
