THE LOUIS CHEMIS CASE. By Tthgraph.—Pms Amciation. Wellington, Monday. The Appeal Court opened this morning. Only five cases are set down. The first taken was an appeal of behalf of Louis Chemis, undor a special Act passed this session. Mr Jellicoe applied for a new trial ' On the ground that tho -ovidence at the former trial-five years ago—in possession of prisoner's counsel, and evidence since discovered, ► might have led the jury to a different conclusion; and secondly that Jfy) evidence wns obtained by the flair practices of two of the Crown v witnesses. It was pointed out, however, that the Act only enabled an application to be made on the ground that a verdict was against the weight of cvidenco, and the Court unanimously said they could not look to anything ' outside the evidence at the trial. Mr Jellicoe thereupon said hecould not go on and the Court refused the motion.
