MEETING OF CREDITORS

ESTATE OTWm. NEILL.

The adjourned meeting in the estate of William Neill was held yesterday, the D.0.A., Mr \V. B. Chennells, presiding. The creditors present were Messrs A, W. Renal!, J. lorns, Thos. Wagg. Mr Beard was present on behalf of tlie petitioning creditors. The D.O.A, stated tlmt he had made enquiries re the money disbursed by Mr Gawith, which was £l5O, and not £250 as stated by the

debtor. The debtor was not present having wired him to send a pound ■> for twin expenses. The receipts for the furniture in Mrs Neill's name Mr Pownall stated were now in Wel-

lington. The piano was purchased in 1892 in the name of Mrs Neill, on tie hire system, and is now held by Simms & Mowlem, who paid %p the payments, £l4, when they j seized the piano. He had also ascertained that a horse sold recently was the property of Mrs Neill, With regard to this if there was any surplus when the instrument was sold it would be the property of the creditors. The creditors would have

to consider that at present there was

no funds in the estate, and so far as ho could see, very little chance of any; and before ho could take any action, the creditor would be required to employ a solicitor or guarantee the cost to the Assignee's solicitor. Mr Beard asked if tho fnini-

turo was included in a bill of sale to Mr Vallance. The debtor had stated ' in his evidence that Mrs Neill had . consented to including the furniture in the bill of sale. . The D.O.A. said lie considered that it was certainly a case in which every effort should be made to prevent the debtor getting away with the whole

of the furniture without question, , , Mr Beard said that practically the Creditors present were not inclined 4w) bear the whole cost of testing the rase.

Thomeeting was furtberadjourned to allow the creditors to consider whotber thej' would bear tlio cost of the proceedings. In reply to Mr Beard, Mr Chenstated that from facts which > , had como to his knowledge there was every reason to believe that the action taken would succeed in proving that the furniture was Neill's and any surplus over the statutory allowance could be secured for the benefit of the estate.
