Tho case against Davy charged with falsely applying a trade mark to a machine covering was a remarkable one in that tho legislature had placed the onus on the defendant to prove that he had authority for the trade mark. All the prosecution had to prove was that the trade mark had been applied. He thought it was remarkable for the legislature to assume that it had been falsely applied, and to placo onus on the accused.
