W. 11. Cole v, W. J. Pearse and the Rev. Father McKenna,—Mr Beard for plaintiff, Mr Bunny for sub-debtor Father McKenna. Claim £9los. The case was brought to show cause why an order of attachment should not be granted. The Rev. Father McKenna stated that the contract had been completed on the 19th January, and a sum of £4O was held for thirty days under the Workmen's Lien Act, after the completion of the work. Witness had received claims, and fiom statements inado by workmen the amount in hand would not cover them.

To Mr Beard : The only money in hand due to Pearse was the £lo'l7s specified. Cole never worked on the job and witness did not know of his claim.

This application was refused, Hayes v. G. Daysli. Disputed claim for wages, at the rate of seven shillings per day Mr Pownall for plaint iff,and Mr Beard for defendant, The sum of £7 16s was paid into Court.
