A.J.P. FINED FOR ASSAULT.

Mac Donald chargod John Toomey, Justice of the , Peaco and City Councillor, with ' assaulting him. It appeared that . when MacDoiiald got into the last car for tho valley, Toomey who was sitting some distance from him , became excited, and declared he ) would thump him or kill him. Toomey instead of getting off near s his own home remained in the car . till MacDoiiald got out, and he then followed him, and, it was alleged, , struck him on the head and hand, b with a stick, and tore his coat and overcoat. MacDoiiald .who., is. lame, defended himself as well as he could and finally got rtwsiy. 1 For tho defence it was alleged that Toomey ? had gone to'the Valley to get the > key of a house, and gotoff toremon--0 skate with Mac Donald for persecuting him by keeping away-from him t hotel valuation business. Toomey • alleged that Mac Donald first raised " his stick. Mr Carew. S.M.,said in bis opinion the assault was premedic tated, and he would inflict the highest 0 penalty allowed by the Act. Toomey , was fined £5 and costs £5, or in default one month's imprisonment with hard labour. Defendant was ■ also ordered to enter into recognis- • linces, himself in £SO and two s sureties of£2s each, to. keep the ' peaco for six months. On the charge ' of malicious injury defendant was fined Is, and ordered to pay damages '. £3, and costs 28s, or in default seven B days' imprisonment, which was tobe • cumulative on the previous Sen- , tenco, ..' ■
