Pauierston N,, Thursday. Judgment in a cuso of cor-Biderable importance was given to-day by District Judge Kettle. The case was one in which Mr T, Tra6k sought to recover damages from the New Zealand Railway Commissioners for injuries received by avail, horses and harness, owing to tlio alleged negligence of the driver of ou engine, which collided with the horse's while crossing the line at a private crossing. The case was heard before a jury, who returned a verdict for plaintiff on one of the issues submitted to' them, Judgment was reserved to allow the defendants to arguo a non-suit point. This was argued at the last sitting of the Court, and to-day Judge Kettle upheld the verdict of the jury, and dismissed the'motion with costs against defendants. Nottco of appeal was given.
