At the outset Mr Poynton made an application on behalf of Mr Lindsay to wiih(lra\y from the petition but as the other petitioner, Kobell, refused to consent to the withdrawal of the petition, JJr Poynton could not proceed witl] tilt) petition, but ho whs obliged to, owing to the refusal of the other to withdraw, Mr Jellicoe then moved to expunge from the files of the Supreme Court the so-oalled petition on grounds (1) the petition was not presented to Returning Officer in a proper manner, (2) that no pecurity, as in the statute required, was given in the manner and within the time prescribed.
