. MASTERTON-SATURDAY. (Before Mr T, Hutchison, 8.M.) C,A. PownallandW, O.Cargill v. B. J. Malcolm and jf. 0. Eastwood. r-Mr' Beard, who appeared for the defendant Eastwood, addressed the Court on the above case, which was adjourned yesterday. He applied for a non-suit and submitted that there was not a tithe of evidence to support the aljogatipn of fraud against Eastwood, by whom there had been no misrepresentation. Any remedies which the plaintiffs had were against Malcolm. His Worship said he would give judgment on tbe case on Monday. His impression was that there was no case against defendant Eastwood, but only against Malcolm. Ibo Court then adjourned,
