This isan action in which James Pirie Clark, draper, carrying on business at Pahiatu'a, sues Edward Nay- *, blacksmith, of Fahiatua, for £IOO mages for alleged slander. Tho statement of olaim sets forth (1) That in or about the months of December 1891 and January 1892, and at divers times thereafter, at Pabiatua, the defendant falsely and maliciously spoke and published of, and concerning the plaintiff, the words following and words to the like effect " This was not intended for me. It would never have happened if it had not been for Dickson," " I believe that Clark (meaning the plaintiff) was the man that did it and nobody else." " That Clark had poisoned Dickson and other persons, and had only escaped proceedings through beirgaMason."That Clark waa tho man who had put the poifion in the meat at my houso" (8) That in Bpeaking and publishing of and concerning the plaintiff the matters aforesaid, the defendant meant that the plaintiff had been guilty of an indictable offenoe.
