MABTERTON.-FRIDAY, (Before Colonel Roberts, R.M.J A..GUEQUE, Henry Hussell, 'an elderly and decrepit individual, was charged on remand with having obtained and appropriated to his own use a cheque of the value of £ls 10s, the property of Alexander Frasor. Sergeant M'Ardle prosecuted, John Lincoln Murray deposed that on Saturday, tho Gth inst., the accused went into the premises of the Wholesale Drapery Company to purchase goods. He tendered a cheque for £ls 10s drawn on Mr M'Kenzie, iu payment for the goods purchased, whioh amounted to £ll2s lOd. The accused, in anßwer to a question, said the cheque was mado payable to him as Angus Fraser, Witness gavo a cheque on the Company for £lO, and BMje cash as change. Wexander Fraser, on oath, deposed that on Thursday, the 4th inst,, he received a chequo drawn by W. M'Kenzie for £lslos, ;On tho flame day he was riding lo the Opaki and lost the oheque,whioh he had collected for Angus Fraser, and for the amount of which he was responsible. He saw Mr J. L, Murray on the following Monday, and the cheque was produced by him. Be gave no authority to any person to cash tho cheque. Orlando Pragnell, in the employ ol the Wholesale Drapery Company, deposed to the accused having made certain purchases on Saturday and tendered the cheque for £ls 10s in payment, giving the name of Angus Fraser. The accused tried to caflb the cheque given him by Mr Murray on the Monday morning, and was then arrested by Constable Uashion, Constable Cashion deposed to the arrest. Tho accused paid he had nothing to say about the matter, and was formally committed to take his trial a&eiiext criminal sitting of the Supreme Court in Wellington,
