Mr Aoheson for informant, Mr Middleton for defendant, Counsel for defendant objected to this case being reheard aa it bad been beard at the last Bitting of the Court and dismissed. The ob» jection was disallowed and the counsel for (he informant opened the cab's and stated it was one in which the defendant whs charged with that he did on the 24th May,last unlawfully rescue three horses from the informant while in the' act of impounding them for trespass. After hearing the evidence of E, W. Dorsetr, J. A. Dudson and James Darroch for the informant, and John Battershee, the defendant, and G. W. Deller for the defence, the information was dismissed with cosis 10s, and Bolioitor's fee 21s,

The charge of 80s perweek which be made was not excessive for looking after sheep in lambing,
