T, E, Price v, C, Benzie.—Claim £7.- Judgment for tho amount, with Court costs, 6s, Mulcahy v, Kean-This was an adjourned case, and was a claim for £UlGs9dfor bnshfalling done and , £2O damages. Mr Pownall appeared for the plaintiff and Mr Bunny for the defendant. Mr Pownall briefly stated tho cir- : cunistancesot the case. Patrick Mulcahy, sworn, deposed ! that ho had been working with two yr others on a contract taken from tho defendant, Tho busb was to bet felled at the Upper Taucru, The property was boing managed by a man named Kichard Clark when the contract was taken. He tendered at first for 2G2| acres, He was subsequently told that if he cared to take 100 acres at 28s per aero he could do so. This he declined unless the speciGcations were altered. He afterwards offered to do the work, the defendant having agreed to the alteration, and tho offer was accepted, At witness' request the area pf land to be felled was altered to'eighty acres,. He, then signed an agreement. The agree* ment produced' was not' the ouo signet'. .They started work and continued till just a week before Christmas, when they received an advance of £4O from the agent cf the defeat dant. Tliey stopped work on 23rd December, as they did not know where to go or what to do, there being" no lines cut, Clark, the manager for . defendant, told him Mr Frazi would & go up and cut the lines,,' Mr ; Frazi did not put in an appearance till the . 29 th December, when he simply cut a line around what they had done. They started on Frazi's line, but before they had finished 1 Clark told' them they must knock off, : They 'were delayed a week or, ten "days waiting for Mr' Frazi.. They' iad! received £4lloa on,account, ivhioh left £\i lGs :; 9d owinsf. . They also claimed £2O damages for the time they' were kept waiting.
