R.M. COURT.
EKETAHUN A.-WEDNESDAY. (Before Messrs H. Aulin and. A. Anderson, «T.F.'s.) Ajther W. Foden was charged by Constable Roche with being drunk and disorderly in a public place on September Ist. The accused pleaded not guilty. Constable Roche conducted the prosecution and Mr Eton defended. By Constable Roche : I know acaccused. Remember on the Ist September when I saw him drunk in crossing the street in charge of young Sawyera. I followed him into Toohill's Hotel and saw him lying on the floor quite incapable, Wm. Murdoch, called, stated he remembered Ist September and knew accused. Thought he was drank or unwell. Mr Eton; Would you swear he was drunk?—No { Constable Roche : Did you not try and engage another player for the ball ? Mr Murdoch : Yes. Alexander Mangnuaon, W. Cameron and W. A. Bowse also gare evidence. Mr Eton submitted that the charge was not proved. For the defence Sawyera deposed : I know the accused. I was sent into the Eketahuna Hotel to fetch him, went across the road with him but did not assist him. Constable Roche severely cro3B-ex ■ amined this witness but could only elicit the fact ihat his hand was resting on his shoulder. M r Toohill also gave evidence, but as be was not at home at the time, he did not gee apcußed. He found him quite sober when he returned s and preparing to go to the ball. The case was dismissed.
