ENCROACHMENT OF WATER.
Action for Damages.
Taylor 7 EonallWEDNESDAY. On resuming at two o'clock— AW Renall was cross examined and re-exauiiued at great length. Evidence for the defence was also given ty Messrs Parker and Haftka. Mr Beard then raised the -|uestion of prescriptive nghts.maintaining that Mr Renall had no right to the drain. His Honor announced that he would consider the question, and the Court then adjourned till next day. THURSDAY. Ou resuoiing, His Honour announced that he did not coneider the question of prescriptive rights material to the case, but would hear evidence. Mr Beard then called rebutting evideuce.
James Walker, a lesident of twenty five years.deposed that Mr Renall had
received consent from the Masterton Local Board to cut his drain' about seventeen or eighteen years ago. William Adams deposed that ho had purchased section 62 from Mr Cave in 1869. He sold to Mr Renall about 1878. The drain was cut after Mr Renall bought from him. Evidence was also given by Mrs Hounslow and another. _^ The minutes of the Road Boarci meeting of June, 1872, were produced by Mr Renall, showing that at that date the right to cut a drain was granted. Mr Beard asked that the minutes of subsequent meetings of the Board be produoed. The Court then adjourned till two o'clock.
