Ikfbingement of the licensing act,
Kate M. Garden,.: proprietress of the Marquis of Normanby Hotel, Carterton, was charged by Constable Darby with that she did on tfie 28th day ot May, 1891, allow gambling to be carried on in a house oucupied by her.
Mr Acheson appeared for the accused, and objected to the information on the .grounds that the accused was only appointee for Mr J. h, Kinibell, to whom the license was granted at the last License Committee meeting. A permit from tho Licensing Committee was put in injevidence to show that the accused was a lawful manager for tho holder of the license up to the 7th day of July next. The prosecutor having replied to the objections of the counsel for -the accused, the information ' was dismissed on the ground that it had been laid,against the wrong person.
