The plaintiff Sailed to complete the contract as agreed, and at his request the time for completion was extended till Decern* ber Ist. The plaintiff failed to complete the contract at the end of December. The men were'taken away from the contract after the date when it was supposed to have been completed. The sum of £132, which the plaintiff admitted having received in cash and goods, was more than he was entitled to. As a set off £ 1 per day was claimed from the date when the contract should have been completed. The contract was not finished in the ' terms of the contract.
