CARTERTON-TUEBDAY. (Before Messrs R. Fairbrotber, and J. Baylies, J.P.'s). CEUELTY TO ANIMALS. P. M. Crew vM. Grant. Malicious injury to a horse. Mr Achescn for plaintiff, Mr Beard for defendant. A. Shaw deposed that he was a cadet, and remembered the 2nd April, inst. He saw a horse belonging to the plaintiff, and saw defendant tie a tin to the horse'fTtail with some stones in it. He also saw the horse run away with the tin. lie did not know who cat its m&ne. To Mr Beard : I don't know the age of the horse, but should think it was aged. It was generally running on the road at Gladstone, I did not see it kick the tin. It did not look as it it had a kick in it. It ran about twenty yards with the tin. I did not see any cuts on the animal. I have been at Gladstone over twelve months. I have seen the ammalrunning on the road most of the time. To Mr Acheson : I could not say how long the stiing was, I could hear the horse running some distance after the tin came off its tail. P, M. Crew -deposed that on the day before,mentioned he bad been told that » tin had been tied to bis horse's tail, and when he found him there was hair knocked off his legs and his sheath was pwollen. He was a quiet horse and witness always used him for breaking in young horses. The horse was running on the road at the time. To Mr Beaid : It is not a valuable horse, but still it is valuable to me. J. Strang deposed that the horse was about 25 years old. ■* He saw it the day after the supposed damage, but saw nothing more the matter with it than usnal. He had seen the animal dragging pieces of flax to its tail for weeks together. It was generally on the road. Constable Darby deposed that he had seen the horse but did not examine it particularly to see what damage had been done to/it. A fine of os was inflicted, with costs 38b, and solicitor's fee 21s, in default seven imprisonment.' Mr Beard gave notice of appeal.
