Interestlag to VictimsAsa number of respectable persons in this district have found themselves responsible for forty-two numbers of tbo Picturesque Atlas, at 5s each, ibe following case, beard at Inveroargill on August 21st last, may be of interest
MrEawson, R.M, gave judgment in the Picturesque Atlas- case, a olaim for ,£7. His Worship nonsuited plaintiffs on the grounds that there had been no acceptance of delivery, and the time had not elapsed when payments were due for more than fourteen parts, foi 1 which defendant had already paid,. His Worship said there had been not only an unequivocal refusal to accept,.but damage to the books, for which defendant might be liable, and be held that under the' agreement payment could not he exacted in a lump sum, but at the rate of 5s per month, He held that the Printers and Newspapers Registration Act was not applicable to works published outside the Colony, and overruled the objection that the imprint was insufficient, on the ground that there had been substantial compliance with the Statute. Leave to appeal was granted. The Court was crowded, and the decision loudly applauded.
