The applicant, Mr Ell (son, produced' papers showing advertisement of application for license, and said he had posted the usual'notice on the same, 21 days : before the annual meeting, Ho gave notice to clerk of Bench that the building was'' furnished and completed for public use,, and the fences would be completed in I a few days,, The new'building is chain from.theone destroyed, and it is that much nearor the church., The old hotel was opened six month before the cburckwas opened. The building is about sis chains from - the church on the opposite side of road. ' Mr Ellisou thon gavo a. detailed description of tlio new premises and pointed out that the Hotel would be a convenience to travellers and thoA) people of Alfredton, The building wannot completed in June tind an adjournment was grflntal by the Bench, . Mr Beard, on hehaif of the objectors, addressed tho Bench, informing them that they had no power to grant a license, owing to informality of notice. The Act provided that applicants for pubHoan'a lioobses"niuat state their occupation in the notice of application. also on the notice posted on premises.' Mr Ellison had not done so, and therefore Mr Ellison had no.grounds for a license. In any case a house must be in existence at tho time, of application. Section 56 said thai notice must be posted on tho' same, setting forth name, abode, and occupation of the applicant. Another objection was tb»t on ,10th June Mr Ellison made hiaA application for adjournment, The only—coune the Bench had was to adjourn : the application for one month and no longer. At the end of the oalendar month they, had no further power, He now placed the matter clearly before them, <■ MrTossmll, in.reply said the: flaw in the notice was a clerical error, No one was injured by the error His learned friend had stated that application could be granted for a house not in existence, He only applied for 'alicense no*) - The learned gentleman here quoted the Act to prove that the meeting may adjourn and that if there .was anyone on the Bench who supplied timber to ■ the applicant he had a perfect right to sit on the Bancb. The people who objected to the license were the trustees of the church. The morality of the members of the church bad so altered during this last twelve montha that they must object to the license now. They erected the church after the hotel was eroded, and made no objection at that time, or if they did they would nut have built their church so' close to Cutler's hotol. He sub«v / raitted that the Alfredton should have accommodation, In ' conclusion he said that if this case went further Ellison would defend it, and it would not cost the bench one sixpence, .ay
Mr Beard critioised very severely the address of Mr Tomwill. la reference to the church, the ground was purchased a long time before the church was built,
After further discussion the application wssgrantod on the grounds of the convenience the hotel would be to passengers by tho railway.
