In tho action for Blander, hough by Dr . Mickle against Captain Everest, in the Supreme Court today, the evidence showed that tho plaintiff had attended Mrs Everest for two years for antenna-'and'con-comitant ailments, fie prescribed narcotics for sleeplessness, and on tho 80 th April she took an overdose, and slept so long that her friends sent for Dr Miokle. Wlim he was in tho room Captain Everest came home slightly the worse for drink, Ho expressed no surpriso, mid wasfriendly to Dr Mickle. Afterwards he made statements to several persons, accusing Dr Mickle of improper conduct with Mrs Everest, and of procuring a miscarriage. Shortly after he told two persons that what ho had said was untrue, and were spoken under tho influence of drink. Ho made a written statement to that effect. Later on, however, lie again repeated tho statement, Dr Mickle denied Captain Everest's accusations, and his denial was supported by the evidence.. The defendant did not appear nordefonded his action. Mr Justice Denniston, summing up, pointed out that the action was one. for ordinary slander, and was a class of action which was usually discouraged by the law. There was no claim for special damages. Giving tho greatest credit to the defendant, he felt bound to say that there was not a shadow of foundation for tho statement that there had been impropriety between Dr Mickle and Mrs Everest, The jury retired at 2,55 p,m, and after an absence of eight minutes, returned a verdict for the plaintiff with damages at £IOOO, Mr G. G. Stead, tho foreman, stated that the jury wished to mark their sense of the defendant's action by giving judgment for the full amount claimed.
