Huxtablo v Murrell, claim 7a, Plaintiff stated the amount was balance of accounts for boots and a certain box which lie bail procured to order of defendant's daughter, Tlje amountwas disputed, it being stated plaintiff bad given the box. After several other questions, defendant asked Huxtable if ho did not- say to his daughter that "he had a nice little bedroom at the back,"
His Worship said that had nothing to. do with the present case. Anything ol that sort must bo brought up at anothor time.
Emma M urrell, called by defendant, on oath stated that she was daughter of defendant. Mr 'Huxtable had promised to give here the box if she bought boots. Her brother helped her to tako it home. Asked by her father if Huxtablo had said anything else she answered that Huxtable had said " he had a nice little bedroom, and I could go and sleep there," Cross-examined, by Huxtable she again stated he promised to" give" the box, She had paid for tlio hoots, Sent a small balance by the little girl. Did not receive any receipt for the money, Herbert Murrell (a boy of 11 years) was then sworn, and madothe following statementMr Huxtable had promised that if Emma bought boots off him he would send to Mastertoh and get the box, The box would cost something, but be (Huxtable) would give it to Emma, It would cost her nothing. In answer to His Worship, Huxtable said he had no questions to ask. It appeared they bad been fully trained in telling falsehoods. It was an entire fabrication (the charge against his character) and he was quito unprepared for it. . Murrell said he had another boy to call, who was present on the occasion referred to.
The boy could not be found. The boy Herbert, in reply to his Worship, said that lie did not think it was long ago,' It was in Mr Goddard's house tho conversation took place, where Mr Huxtable was staying. His brother, who was younger than himself, was present, Judgment was given for plaintiff with costs, Judgment was also given in the case Huxtable v Caroline Hooker, claim 7s Gd, The Court then adjourned.
