Tho plaintiff represented the Oceanic Photo Company, Mr Bunny for, plaintiffs, and Mr Beard for defendant. The claim was for enlargement of a photo.

G. M. Gardener, traveller for the Ocoanic Photo Company, proved the arrangement entered into with tbe defendant iu respect to the enlargement of a certain plioto. A. I<\ iMoyer, photographer, of Wellington, in his evidence, considered that the enlargement was quite as good a photo as the original, and that the price was not exorbitant,and thatiie would not do one }jke it for less than £5.

J. Hudsun, one of the plaintiffs in the present action, deposed that the Company was a very extensive one, ranging over the colonies and Honth Africa, and ilio olmrge lor the picture in dispute was reasonable. 0. M. Gardener, re-called, stated that the defendant signed the order for the enlarged photo in his (witness') presence, and that it was not the custom for the Company's agents to deliver hills. The custom was for the picture to be paid for on delivery, -Jmlgment for plaintiff with costs 7s.
