Supreme Court, WellingtonLARCENY AS A BAILEE, Thomas A. Lyons was arraigned mi an indictment charging him with the larceny as a bailee on the 28rd December of a cheque for £2l7s, the property of Ed. Hayes Beauobamp, settler of Wangaehu, Masterton. The prisoner pleaded '"Not Guilty." Mr A. Gray prosecuted, and-Mr 0. P. Skerret't defended. Mr Walter James Hellyer was chosen foreman of tbe jury, Mr Gray opened the case. The prisoner in December last 'had broken in a horse for Mr Beauchauip, the fee charged being £2 10s, He also bad tbe horse shod which brought the amount up. to £2 10s. At this time tbe prisoner was indebted to Messrs Lowes It lorns, auctioneers, of Masterton for a similar amount, and gave them an ardor
drawn on Mr Beauchamp for £2l6s. The order was forwarded in the usual way to Mr Beauohanip, who was' asked; to : remit a cheque. Mr Beauohamp wrote out a cheque for the amount, including one shil-line;-for exchange, and cameintojj&isterton'on the 23rd December, ™ng the cheque with him, to receive delivery of the horse from the prisoner, He received, the horse and was about to go and post,the cheque to Messrs Lowes & lorns, ,when the prisoner offered to deliver it for him. Mr Beauohamp being anxious to get borne gave the oheque to the prisoner. The cheque never reaohed its destination, but' the prisoner it was"subsequently ascertained changed it at a public house in Masterton.
The evidence of Mr Beauohamp and' Joseph lornswas taltefrfpr the prosecution. No evidence was called for the defence, which was to the effeot that that there was no unlawful conversion of the cheque,. The prisoner badj\ pay £1 to his landlord for rentJJLil' he broke the cheque for that intending to pay Messrs Lowes and lorns the amount due to them £1 16s, ; His Honor summed'up, and the jury retired at 12,10 p.m., returning at 5,80 p.m with a verdict ofjjuljfy but recommended the mercy. .Mr. Gray pointed; out -that the accused had previously been convioted for forgery at Timaru, His Honor sentenced the accused to one year's imprisonment with hard, labor.
INDECENT ASSAULT. Edmund Lewis pleaded Guilty to a charge of having indecently assaulted Annie Rhodes, a little girl, on the 2nd of February last. His Honor, in passing sentence, said that the prisonor had pleaded guilty to a very serious oharge. The prisoner was liable, under the laws of the colony, to a term of penal servitude not exceeding seven years, and in 'addition was liable, if such a punishment were fit for such an old man, to a flogging. He (Mr Justice Eichmond) mentioned this to'Jhow what a risk the prisoner himself open to. He did notmink, under all the circumstances, that he was bound to exercise the fullest severity of the law. Prisonecwpuld be sentenced to Terrace Gaol for two years,
Housebreaking, James Alsford pleaded not guilty to a oharge of having broken into the dwelling-house of Mr Edward Eagles at Carterton, on the 18th March. > The defence was that the prisoner, who is an umbrella mender, had gone to the house for the purpose of getting an umbrella to repair, and as no one answered the door he entered. The jury, without retiring, returned a verdict of not guilty, I Laroenn, William Rooke, alias Templeton, alias Woods, alias Piper, wasoharged' with having stolen a gold watch and chain and sovereign purse, value £2B the property of Thomas George Brown, commercial traveller, from the Empire Hotel, on 28th January last,
The jury retired at 10,40 p.in, and as they could not agree to a verdiot were locked up all night. The Court adjourned at 12.80, until 100 this morning. (-*■ Wellington, &%. Mary Snith, found guilty ofiforgiing a cheque in her employer's name I name, was admitted to probation for one year, paying tho costs of the' prosecution. ltobert Parker, found ! guilty of larceny was also admitted to probation, with tho addition of entering into recognisances, himself and another £IOO each. R. T. Price for larceny was sentenced to two years hard labor, His Honor refusing probation.' In the case against-Templeton, charged with tho robbery of gold watches at the Empire Hotel, the jury were locked up all night, and this morning they had still failed to agree, and were discharged. A new jury was impannelled and tho oase is being ro.-tried.
